Gabriel/RMGC's Statement Regarding the Decision of the Bucharest Court of Appeal in EIA Case

 Toronto, Canada: July 2, 2009 -- Gabriel / Rosia Montana Gold Corporation (RMGC) further states, as it has from the beginning, that the EIA procedure does not require a valid urbanism certificate (UC). This has been the reason behind the litigation between RMGC and the Romanian Ministry of Environment.

At present, according to our Romanian legal advisors, there is no legal basis in European Union environmental law or Romanian environmental law (which is the same as EU environmental law) for suspending an EIA review process. Nor is there any legal provision in EU or Romanian environmental law requiring the existence of an UC in order to undertake the assessment phase of an EIA review (the TAC review process in Romania).

The Bucharest Court of Appeal has yesterday ruled on a procedural exception of the Environment Ministry, former Environment Minister and former secretary of state, unrelated to the principal issue of RMGC's legal challenge. The effect of this decision is to dismiss RMGC's claim, however the decision failed to address RMGC's principal question, being whether an UC is required to conduct the EIA review process. RMGC will analyze the Court's decision, once received, and the reasons which led to it and will decide its further actions.
